2. Scope

These General Terms and Conditions (GTC) apply to the purchase of goods via our online shop by consumers and entrepreneurs. The version valid at the time of the order is binding. Individually negotiated agreements take precedence over these GTC.

Consumers are customers who enter into a transaction for purposes that are not primarily related to their commercial or independent professional activity. Entrepreneurs are customers for whom the contract is part of the operation of their business. Mandatory statutory provisions regarding consumer status remain unaffected.

Diverging terms and conditions of entrepreneurial customers only become part of the contract if we expressly agree to their validity.

3. Order and Conclusion of Contract

The presentation of our goods in the online shop constitutes an invitation to place an order. You can initially place items in the shopping cart without obligation. Before submitting your binding order, you can review the displayed information and correct it using the functions provided during the ordering process.

By clicking the final order button, which clearly indicates the payment obligation, you submit a binding offer to purchase the goods listed in the order process.

After placing your order, you will receive an order confirmation via email. We accept your order with this order confirmation; the purchase contract is concluded upon receipt. Should the purchase price actually be collected before this, this collection already counts as acceptance of the order. A mere payment authorization or reservation of an amount does not constitute collection.

Before our acceptance, we may reject an order, especially if the ordered goods are not available. After the contract is concluded, we are not entitled to unilaterally cancel your order or reduce its scope without a legal basis or your consent. Your statutory right of withdrawal as well as the other statutory rights of both contracting parties remain unaffected.

The contract language is German. You can save or print these GTC before placing your order. The order data and the agreed contract information, including these GTC and the cancellation policy, will be provided to you via email.

We store the contract text, including the order data and the GTC agreed upon at the time of contract conclusion. You will receive these documents via email and can save or print them yourself. You can request a copy by contacting uk@valentina-philippa.com.

4. Prices, Shipping Costs, and Payment

All prices are stated in Euros. For deliveries within the European Union, the displayed final prices include the applicable statutory VAT. Shipping costs may be added. The total price including taxes and the shipping costs calculated by us will be displayed to you before you submit your binding order.

Shipping costs and the conditions for free shipping can also be found on the “Shipping Information” page in the online shop.

For deliveries to Switzerland and Liechtenstein, no Austrian VAT is charged. The corresponding price adjustment will be made at the latest during the order process after selecting the country of delivery. Additional import duties, customs duties, and potentially fees charged by the delivery service are not included in the price calculated by us and may have to be borne by the customer. Further details are provided in the shipping information.

You can choose from the payment methods offered during the respective ordering process. The available payment methods and any deviating payment deadlines will be displayed there before you place your order. Unless otherwise expressly agreed, the purchase price is due upon conclusion of the contract. In the case of agreed advance payment, shipping will take place after receipt of payment.

5. Delivery

We deliver to the delivery address you specified in Austria, the other member states of the European Union, as well as Switzerland and Liechtenstein. The delivery options and delivery times specified before the conclusion of the contract are binding.

Partial deliveries are only made if they are reasonable for you and do not incur additional shipping costs, or if you have expressly agreed to them. Statutory rights in the event of delivery delays or non-delivery remain unaffected.

For consumers, the risk of loss or damage to the goods generally only passes upon delivery to the consumer or to a third party designated by the consumer who is not the carrier. If the consumer commissions a carrier themselves without using a shipping option proposed by us, special statutory provisions apply.

6. Warranty, Guarantees, and Liability

Statutory warranty rights apply. For consumer contracts, the mandatory provisions of the respectively applicable consumer warranty law apply in particular. These rights are not limited by these GTC.

An additional guarantee only exists if it is expressly promised for the product in question. Its content is governed by the respective guarantee statement. Statutory warranty rights exist independently and are not limited by a guarantee.

Our liability is governed by statutory provisions. Claims for personal injury or property damage as well as claims under product liability law remain unaffected.

7. Right of Withdrawal for Consumers

Consumers generally have a statutory right of withdrawal when purchasing goods via distance selling. The following information and the model withdrawal form explain how to exercise it. Entrepreneurs do not have a statutory right of withdrawal for consumers.

Cancellation Policy

Right of withdrawal

You have the right to withdraw from this contract within fourteen days without giving any reason.

The withdrawal period is fourteen days from the day on which you or a third party named by you, who is not the carrier, has taken possession of the goods.

If you have ordered multiple goods as part of a single order and they are delivered separately, the withdrawal period is fourteen days from the day on which you or a third party named by you, who is not the carrier, has taken possession of the last good. If goods are delivered in multiple partial shipments or pieces, the period begins upon receipt of the final partial shipment or piece by you or the third party named by you who is not the carrier.

To exercise your right of withdrawal, you must inform us, KTG Kaufmann GmbH, Unterries 1, 6850 Dornbirn, Austria, Phone: +43 664 4053484, E-mail: uk@valentina-philippa.com, by means of a clear declaration (e.g., a letter sent by post or email) of your decision to withdraw from this contract. You can use the model withdrawal form below, although it is not mandatory.

You can also exercise your right of withdrawal online via the "Withdraw from contract" function linked in the footer of our online shop. If you use this online function, we will immediately send you a confirmation of receipt on a durable medium (e.g., via email) with information on the content of the withdrawal declaration as well as the date and time of its receipt.

To meet the withdrawal deadline, it is sufficient that you send the notification of the exercise of the right of withdrawal before the withdrawal period has expired.

Consequences of withdrawal

If you withdraw from this contract, we shall reimburse all payments we have received from you, including delivery costs (with the exception of additional costs resulting from your choice of a type of delivery other than the cheapest standard delivery offered by us), without delay and at the latest within fourteen days from the day on which we received the notification of your withdrawal from this contract. For this repayment, we use the same means of payment that you used in the original transaction, unless expressly agreed otherwise with you; in no case will you be charged any fees for this repayment.

We may withhold reimbursement until we have received the goods back or until you have provided proof that you have returned the goods, whichever is earlier.

You must return or hand over the goods to KTG Kaufmann GmbH, Unterries 1, 6850 Dornbirn, Austria, immediately and in any case no later than fourteen days from the day on which you inform us of the withdrawal from this contract. The deadline is met if you send the goods before the period of fourteen days has expired.

You bear the direct costs of returning the goods.

You are only liable for any diminished value of the goods if this loss in value is due to handling the goods in a way that is not necessary for examining their nature, properties, and functioning.

End of the cancellation policy

Exception for sealed hygiene products

For goods that are delivered sealed and are not suitable for return for reasons of health protection or hygiene, the right of withdrawal expires if their seal has been removed after delivery.

This exception applies to cosmetics and care products only if the aforementioned conditions are actually met in the individual case. Merely opening the shipping packaging does not lead to the loss of the right of withdrawal. Statutory warranty rights for defective goods remain unaffected.

8. Applicable Law and Jurisdiction

For contracts with consumers, the applicable law and judicial jurisdiction are governed by statutory provisions. These GTC do not exclude or limit any statutory consumer courts.

For contracts with entrepreneurs, Austrian law applies, excluding the UN Convention on Contracts for the International Sale of Goods. For disputes arising from such contracts, the jurisdiction of the factually competent court for Dornbirn is agreed, as far as legally permissible.

9. Final Provisions

Should a provision of these GTC be wholly or partially invalid, the remaining provisions remain effective. The relevant statutory regulations shall replace the invalid provision.
